DMCA & Copyright Policy
How we handle copyright claims and protect creators' rights.
Section 01 / Position
TuneFreq exists to help artists sell their music directly to listeners. We expect artists to upload only music they own or have permission to distribute.
We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid copyright infringement notices. We also protect artists from false claims.
Artists: You retain all rights to your music. Uploading to TuneFreq does not transfer ownership to us.
Copyright Holders: If you believe material on TuneFreq infringes your copyright, follow the process below to file a claim.
Section 02 / Claim
If you believe material on TuneFreq infringes your copyright, send a written notice to our DMCA agent at [email protected] with the following information:
- Identification of the copyrighted work: Describe the work you own (e.g., "The song 'Title' by Artist Name").
- Identification of the infringing material: Provide the URL of the TuneFreq page containing the infringing material (e.g.,
https://tunefreq.com/@artist/releases/album-name). - Your contact information: Name, address, phone number, and email address.
- A statement of good faith: "I have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law."
- A statement of accuracy: "The information in this notice is accurate, and I am the copyright owner or authorized to act on the copyright owner's behalf."
- Your signature: Physical or electronic signature.
What Happens Next:
- We'll review your notice within 2 business days.
- If valid, we'll remove the material and notify the artist who uploaded it.
- The artist may file a counter-notice (see below).
False Claims: Filing a false DMCA claim can result in legal penalties (perjury). Only file claims if you genuinely own the copyright or represent the owner.
Section 03 / Counter
If your upload was removed due to a DMCA claim and you believe the claim is mistaken or invalid, you can file a counter-notice to [email protected] with:
- Identification of the removed material: Describe what was removed and where it was located.
- Your contact information: Name, address, phone number, and email.
- A statement of good faith: "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
- Consent to jurisdiction: "I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if outside the U.S., any judicial district in which TuneFreq may be found."
- Your signature: Physical or electronic signature.
What Happens Next:
- We'll forward your counter-notice to the person who filed the original claim.
- If they don't file a lawsuit within 10-14 business days, we'll restore your upload.
- If they do sue, the legal dispute is between you and them (not TuneFreq).
Section 04 / Repeat
TuneFreq has a zero-tolerance policy for repeat copyright infringers. If an artist receives multiple valid DMCA claims, we will:
- First offense: Warning and removal of the upload.
- Second offense: Temporary suspension of upload privileges.
- Third offense: Permanent account termination.
We believe most infringements are mistakes (e.g., an artist uploads a remix without permission). But intentional, repeated infringement harms the community and will not be tolerated.
